The Central Administrative Tribunal (CAT) on Friday set aside appointment of Shankar Barua as Director General of Assam Police and asked the state government to prepare a new panel for appointing a new police chief within a month. However, it directed that Baruah continue in the post till alternative arrangements were made.
The CAT order came in the wake of an application filed before it by senior IPS officer Sharada Prasad, who had challenged the appointment. Prasad, a 1973 batch officer currently posted as DG, Vigilance and Anti-Corruption Bureau of the Assam Police, had in his petition stated that since he was a year senior to Barua, he was more eligible for the post. A two-member Bench of the CAT quashed the state’s notification of July 2009 appointing Baruah as DGP. It observed that the rank of DGP was a promotional case and not a transfer and posting case as would appear from the notification. The CAT also mentioned that not enough grounds were given for supercession of Prasad while appointing the DGP.
Baruah, a 1974 batch IPS officer, was appointed DGP with effect from August 1 last year following the retirement of G M Srivastava.
